LIMITED WARRANTY FOR USED ENGINE LONG BLOCKS & TRANSMISSIONS
Definations:
Buyer or Customer : The one who makes the payment by cash or by his personal or his business credit or debit card with his name on it or by his personal or business check.
Carrier or transporter : The shipping company, truck, trailer or be it any vehicle that transports the sold
item to be delivered to the customer.
Re-stocking or Cancellation fee : Fee charged by us for cancellations before the item is accepted by
the customer explained in clause # 4 of this warranty but after a valid payment explained in
clause # 6 of this warranty.
We, Our, Seller : means Engine World USA or BAPL USA Inc.
Clause : means text or section of text that is a part of this warranty.
Shipping delivery notice: Document presented by the carrier or transporter for the
customer to sign as proof delivery or acceptance.
Item / Items : Engine long block or transmission.
Freight Terminal : Office, warehouse, dock or legal address of the carrier, transporter
or shipping company.
Parties, us : means Engine World USA & customer.
Contract or Agreement : means and refers to this warranty document.
Replacement : Exchange of item sold with another one in used and working condition.
Working condition : Used engine or transmission in running or working condition
when they pass tests conducted by us.
What we sell: We sell used engine long blocks & transmissions in working condition. Long-block means just bare block with cylinder head. Long blocks do not include external add-on parts, sensors or accessories. In case of a transmission, flywheel, torque converters, sensors, cables, switches, shift-linkage, external seals, solenoids, plugs, flex plate etc are not included. The engine may have emission devices like intake & exhaust manifolds, EGR valve etc but since they are all according to Japanese spec and made for Japanese emission standards, it is every customer’s responsibility to replace them from their old engine to meet EPA regulations. Also external accessories like Alternator, power steering pump & AC compressor may be included which will carry no warranty. Applicable state laws may vary from state to state. Add-on accessories are specifically excluded from the warranty offered herein. We do not guarantee that the item sold will be from Japan or from a specific location, we sell engines solely on the basis of tests conducted on the basis of our expertise, we also do not guarantee the item to have a specific mileage but our endeavor will always be to stock engines and transmissions with lowest miles possible, our only aim is to sell used engines and transmissions in working condition. Mileage we refer to in our advertisement is only approximate.
1.Terms:
Used gasoline long-blocks 6 months or 6000 miles, whichever comes first starting from the
date of receipt.
Used diesel engines : 30 Days or 1000 miles, whichever comes first starting from the
date of receipt.
Used Transmissions: 90 days or 3000 miles, whichever comes first, starting from the
date of receipt.
NOTE: We also offer 3 year or 36000 miles warranty on our engines for an extra charge through an independent warranty company that includes "labor" coverage. In such a case all customers must agree and follow all the terms and conditions mentioned in warranty contract of that warranty company. Such warranty initiates after the engine is installed. Customer must notify the warranty company in writing of the installation date. Engine World USA under no event shall be liable for any warranty claim whatsoever if customer purchases the engine with 3 year or 36000 miles warranty.
Performance engines: All DOHC VTEC, SUPERCHARGED, ENGINES WITH TURBO
& ROTAR ENGINES carry a basic 30 days start up warranty from the day it is ordered.
Where start-up means “ Engine is not locked up & crank rotates”
Warranty is non-transferable and is valid for the original owner. It terminates upon sale
of the vehicle. Vehicles with non-operative or defective odometer will be considered to have a
coverage rate of 1500 miles per month.
2. Warranty Coverage for engine long blocks & transmissions: Internal engine parts including,
Pistons, piston rings, crankshaft, main bearings, connecting rods, rod bearings, camshaft, camshaft bearings, timing chain, timing gears (except Nissan & Infiniti), Intake and exhaust valves, push rods, rocker arms and shafts. The engine block & cylinder head are warranted to be free of cracks or distortion but all customers must inspect the engine block for cracks in the presence of the transporter and before signing the shipping delivery notice at the time of receiving the engine, failure to do this will invalidate all claims for a cracked block. Japanese engines may have different displacement and / or different external parts or may look different but will fit adequately in the application we sold it for, once the external parts are replaced or modified.
In case of a transmission, only “ internal Gear-set” is covered under warranty. We also warranty that transmission housing will be free of cracks but it must be inspected in the presence of the transporter, before signing the shipping delivery notice, failure to do so will invalidate all claims for a cracked housing. External parts like torque converter, flywheel, clutch, pressure plate, output shaft, bands, external seals, bushings, switches, plugs, cables, shift linkage, governor, flex plate, cooler are not covered under this warranty.
3. Warranty Limitations & exclusions or circumstances that will void the warranty:
A. Engine or transmission must not be pulled out of the vehicle before filing the claim.
B. Prior authorization in writing is required from us before starting repairs, replacements, disassembling or modifying or pulling the engine or transmission out of the vehicle.
C. Warranty does not cover shipping, towing, freight or delivery or handling charges. We will not accept any return shipments as C.O.D or freight collect or even if freight is paid, without a prior written authorization from us.
D. Warranty does not cover LABOR charges under no circumstances.
E. Damages, defects or decrease in performance due to failure of parts that have wear and tear like: timing belts, timing tensioners, guides, hoses, any kind of oil or air filter, front & rear main seals or any external seal, oil pan, harmonic balancer, mounts, valve cover, thermostat & water-pump gaskets, thermostat & water pump assembly, solenoids, EGR valve, oil pump or any external gasket except head gasket is not covered. Oil leaks due defective gaskets & seals, oil pump is excluded. In case of a transmission : damaged oil pan, external sensors, switches, oil pan gasket, fluid leaks, clutch kit, damages due to faulty torque converter, shift linkage, cooler, solenoids, governor, neutral safety switch, pressure plate, flex plate, mounts or flywheel are not covered.
F. Oil leaks, blown head gaskets or any other damage due to overheating caused by poor water circulation, clogged radiator, faulty thermostat or water pump or damaged radiator or cooling system malfunction.
G. Damage as a result of timing belt or tensioner failure or misalignment, wrong timing. Bent valve, lock up or back fire due to wrong or faulty timing belt or improper installation or any damage as a result of direct or indirect timing belt failure.
H. All external parts, accessories & sensors are not covered in case of engine & transmission, namely: intake, exhaust manifolds, carburetor, turbos, superchargers, distributor, alternator, power steering pump, thermostat, water pump, seals, belts, hoses, tensioners, pulleys, oil pan, switches, cables, wiring harness, mounts, starter, AC compressor etc. In case of a transmission: torque converter, flywheel, clutch assembly, pressure plate, axles, mounts, cables, wiring, cooler, oil pan gasket, all external gaskets & seals, shift linkage & all sensors, switches, plugs, mounts, brackets, solenoids etc
I. Damage due to no oil or insufficient oil in the engine or low or excess fluid in the transmission.
J. Damage due to neglect, abuse, accident or natural perils, overheating, fire, collision, over revving, road hazard, or if used for competitive driving or racing or commercial use or due to failure of parts not covered under warranty. Claims are also invalidated if repairs or adjustments were made without our prior written authorization & if a different engine is used from what the car was actually manufactured with, corresponding to that particular VIN number. If turbo, supercharger is installed or if an engine is modified or enhanced with extra horse-power in any manner, warranty is void.
K. Damage due to improper installation or caused by dropping objects into combustion chambers.
L. Damages due to modifications or changes to use in an application for which the engine or transmission was not designed for.
M. Customers are required to follow tune-up procedure & all NEW tune up parts listed in clause # 9 of this warranty must be replaced. Maintenance requirements explained in #9 must also be followed.
N. Pre-ignition damage: Claims for a defective engine or transmission are invalid unless they are installed in the vehicle.
O. Costs associated with failed state inspection.
P. Installation or use of an engine without original emission devices transferred from the original US version engine is prohibited. Any act that contributes to violation of EPA requirements will void warranty.
Q. Costs associated with wrongly ordered engine or transmission are not covered. Customer must provide full description while placing an order. In case of transmission especially he must inform if it is automatic, manual, 2wd, 4wd, electric or mechanical governor or cable or electronic speedometer.
R. Silver-nickel-like Heat tabs are installed on the block of every engine we sell. If tabs are removed or melted at around 225 degree Fahrenheit, warranty is void. It is customer’s responsibility to check the location of heat tab and make sure it does fall of during installation. In case of transmissions, removing identification barcodes will void warranty. Transmissions are marked for identification. Tampering with or altering embossed identification codes will void warranty.
4. Cancellations, Return & Refund Policy: Once the buyer or customer accepts the item
warranty is limited to repairs or replacement only. “Acceptance” means when customer or buyer accepts the item or is dispatched or delivered to the buyer in person or someone on his behalf with his authorization and item leaves our business premises in case of a local pickup from our Houston warehouse. “Acceptance” when we ship the item using an independent carrier and is not picked up by the customer or someone on his behalf from our Houston warehouse in person, means signing the “shipping delivery notice” or any such document which the carrier makes the buyer sign for the purpose of proof of delivery. There is absolutely no refund once the item is accepted by the customer. Auto parts are sold as-is with no warranty. Sale can only be cancelled before the item is shipped by us using an independent carrier or accepted by the customer in case of a local pick up explained above. In case of such a cancellation 20% restocking fee will be charged from the total amount received & the balance will be refunded. Under no circumstances sale can be cancelled due the reason that customer found a cheaper engine, if his mechanic increased the installation charges or if shipment can’t be picked up from a commercial location or a shipping terminal or because his mechanic does not want to replace external parts or make minor modifications on the item sold or if customer claims that engine is not from Japan or does not have low mileage or does not have a specific mileage.
5. Delayed shipments : Once the engine is sold, it will not be shipped until we receive following
information in writing from the customer:
or we can fax it.
b. Commercial destination address to receive the shipment.
c. Approval to pick up the shipment at carrier’s terminal if commercial destination is
unavailable.
d. Information to verify credit/debit card details to validate the charge, if paid by credit
or debit card. Normally we require a copy of the card showing only the name,
expiration & last 4 digits.
We are not responsible for a delayed shipment if customer does not inform us of above details in spite of our repeated reminders. A certified mail notifying the documents required will be sent after three email or fax notices. Delayed shipments resulting due to insufficient information regarding item model, year or type provided by the customer or in such case if we do not receive to-the-point reply to our inquiries to avoid shipment of an incorrect item. Sale can’t be cancelled due to delayed shipment if we are waiting on above mentioned information. If we accept cancellation at our discretion customer will be charged 20% restocking fee on the total amount charged and balance will be refunded back to him.
6. Valid Payment methods : Payments made by giving credit or debit card details over the
Phone are absolutely valid and the item purchased shall be deemed sold, only if the transaction is approved with AVS & CVV match. AVS means billing address match & CVV means last 3 digits on signature strip of Visa & Master-card & 4 digits on the front of American Express. Such a payment will be then subject to all the terms, conditions & limitations of this warranty. Any cancellations will be dealt with according to clause # 4 explained above. Customer will be then required to fill out the credit card form at the following link : http://www.usedjapanmotors.com/sendmail.aspx where he will be able to give full description of the item purchased. Payments over the phone will imply that customer has read this warranty and agrees to all the terms and conditions therefore subsequent cancellation of the sale will incur 20% restocking fee which customer will be liable to pay. In the same way payments made by filling out the form at http://www.usedjapanmotors.com/sendmail.aspx will be absolutely valid and will be subject to all terms and conditions of this warranty. Cancellations will be dealt with according to clause # 4 of this warranty.
We are not responsible for payments made by giving credit or debit card details over the phone or a business check by employees of a particular business. All claims by business owners for unauthorized payments will cancel the order but will give us a right to charge 20% restocking or cancellation fee on the total amount charged.
7. Description of Item purchased : Customer must mention all relevant details about the
engine or Transmission he is placing an order for on the form located at the link:

Filing a claim: All claims must be made in writing with full description of the defect with proof of tune- up parts replaced with a legally valid invoice from the vendor & Original Invoice issued by us. The claim can be faxed or sent via email with “Invoice number” on the subject line. Customer’s purchase invoice is proof of purchase. No claim will commence without original copy of the invoice.
9. CUSTOMER’S OBLIGATIONS, MAINTENANCE REQUIREMENTS :
a. Service adjustments, ignition, tune-up, brake & clutch adjustments.
b. Maintenance services recommended by manufacturer, lubrication, fluids, fuel & electrical
systems.
c. Replacement of tune-up parts ( see list below)
d. Engine cooling system servicing : replacing fan belts, hoses, coolant etc
TUNE-UP & MAINTENANCE PROCEDURE ( Failure to follow this will void warranty)
1. Must be installed & serviced by a qualified technician with reasonable experience or
a certified repair shop.
2. Set ignition and timing to specifications as recommended by manufacturer.
3. Replace Gaskets : for oil pan, intake & exhaust manifold, thermostat, water pump, valve
cover, oil pump if it is required to be replaced from your old engine in case our engine
does not have crank sensor & all external gaskets except head gasket.
4. Replace timing belt on all belt driven engines. Also replace belts of balance shaft,
alternator, Ac compressor, oil pump, power steering pump & all other external belts.
5. Must use new engine oil, install oil filter, air filter, thermostat & water pump assembly with
respective gaskets, swap intake & exhaust manifold with respective gaskets from your old
engine, Spark plugs& wires, new timing belt, tensioners, rollers, guides & idlers on all
Nissan & Infiniti engines, front & rear main seals, cam shaft seals, temperature sending
units, Knock sensors, PCV valves, distributor, cap & rotor
6. REPLACE CRANK ANGLE SENSOR IF YOUR ENGINE HAS ONE, BY REPLACING
THE OIL- PUMP FROM YOUR OLD ENGINE.
7. Replace cam sensor while changing the time belt by sliding it over cam tower.
8. Re-torque cylinder head bolts to manufacturer’s specification.
9. Check cooling system. Rod-out service on the radiator is compulsory also change water
hoses. Flow check the radiator or replace radiator if required, don’t just flush. Fill with
new coolant.
10. If the vehicle has thermo-sensor, it must be replaced.
11. Due to minor variations in some engine models, customer will be sometimes required
to make minor adjustments in oil pan, timing cover, EGR valve, oil pick up tube, oil
dipstick, flywheel, clutch assembly, distributor, oil pump etc.
12. Check & adjust valve clearance and tune up.
13. Must replace external seals, input & output shaft seals, axle seals of transmission.
Change oil of torque convertor, replace with new clutch plate, replace pressure plate &
flywheel if worn out or cracked but must be inspected before installation.
14. Fill new transmission fluid, same as recommended by the manufacturer also use the
type of fuel recommended.
15. Flush cooling line before starting the engine. All V6,V8 & Mitsubishi transmissions must
be installed with an auxiliary (new external) transmission cooler. Replace cooler on all
other models if required as it is not covered under warranty.
16 All Toyota transmissions for fwd (Front-wheel drive) must be filled with transmission
fluid into the differential. 4WD transfer case must be filled with fluid / oil as
recommended.
17. Use neutral safety switch from your old transmission.
18. Must reconnect external electrical wiring on engines & transmissions correctly.
19. Check engine oil every 500 miles for first 6000 miles after installation. Clean oil pan &
reseal it before installation. Clean oil pick up tube passage. Replace oil pump is faulty.
10. Warranty procedure: Once we receive the claim, we may decide to call the engine or
transmission for inspection at our discretion after reviewing and verifying that it was
installed correctly, all tune-up parts were replaced, if customer fulfilled all his obligations
according to all terms of this warranty, if none of the terms and conditions of this warranty
were violated. Shipping will be paid by the customer. The engine must be sent back to us
the way we shipped it, with all parts and accessories assembled, the way we sent it.
Upon receipt if we find out that the engine has parts missing or are disassembled we
will return the item & void the warranty. In such a case customer will pay for freight and
shipping cost billed by the carrier. We will arrange pickup once we receive payment for
freight from the customer. All customers must use the shipping document, called
“Bill of lading” which we can fax or email to ship the item to us, using other document than
the one faxed by us will incur extra shipping charges which customer will have to pay once
the carrier bills us. Our shipping documents have our account number with our discount
codes. Please make a copy of “Bill of lading” as one copy will be for the
transporter. Item must be securely shrink wrapped on a strong pallet & available
for pickup from 9 am – 5 pm on the pick up day mentioned on “Bill of Lading”.
We reserve the right to hold the item for 2-7 working days for inspection. All shipping
charges incurred and billed by the shipping company or agent due to customers fault
will be paid by the customer.
We may decide to repair, modify the item or replace it at our discretion. Customer will
receive the replacement item within 15 working days after expiry of inspection period.
We reserve the right to modify or alter our engine transmissions without any obligation
to make it similar to the one previously sold. If we find out after inspecting the engine
that the engine was not installed correctly or was installed in violation of our warranty
clauses # 3 & 9 mentioned above, the warranty will be voided and defective item will be
shipped back to the customer or his agent, from where it was picked up.
11. “Force Majeure” & Shipment of items sold : Delay in delivery or shipment of item
attributable to causes beyond our reasonable control does not give a right to the customer to
cancel the sale. Item will be shipped when circumstances permit. In such circumstances all
terms, conditions & limitations of this warranty will apply. Warranty will start after
customer receives the item. Such dire circumstances beyond our control can be natural
calamities, fire, major strikes, roads blocks due to demonstrations, protests etc. Emergency
situation, Major Power, internet & telephone outages in Houston area, Accident or
hospitalization of our head mechanic or our President, National holidays or due to any or
all transport carrier’s faults Items are generally shipped within 48 hours after we have
received all required information & documents from the customer. If cancellations are
accepted by us, customer will be charged 20% of the total sale amount as restocking
fee and balance will be refunded.
12. Limited Liability: Our liability under this warranty is solely limited to repair or replacement of
used engine long blocks or transmissions with another used one in working condition.
Under no circumstances our liability will exceed the total purchase amount. There is
absolutely no refund once the item is accepted by the customer. Repair or replacement
will not extend this limited warranty beyond the described term in clause #1. To the
maximum extent permitted by applicable law, in no event shall ENGINE WORLD USA
or its suppliers be liable for any consequential, incidental, special, indirect, exemplary
or punitive damages or losses and are specifically excluded from this warranty. We will
also not be liable for claims concerning loss of profits, business interruption, any kind of
injury within our warehouse premises or any other place, loss of privacy, claims of fault,
tort or breach of contract or warranty due to failure to meet any duty including of good faith
or of reasonable care. All claims that the engine is not from Japan or is or not is from a
specific location or does not have specified mileage or low mileage are specifically
excluded. The items may be from Japan or local US market, we sell engines solely on the
basis of tests conducted on the basis of our expertise, we also do not guarantee the item to
have a specific mileage but our endeavor will always be to stock engines and transmissions
with lowest miles possible, our only aim is to sell used engines and transmissions in
working condition. Claims regarding fitness of items for a particular purpose or
manufacturing defects or any or all other claims relating to the product liability concerning
design, fitness, failure to warn and all kinds of injuries, claims concerning negligence or
misrepresentation are explicitly excluded from this warranty.
13. Dispute resolution and Arbitration:Buyer & Engine World USA agree that this clause applies
to any and all claims, disputes, cases or controversies between us or our employees, agents,
successors or assigns, including but not limited to any claims, torts, counterclaims, disputes,
cases or controversies arising from or relating, directly or indirectly, to and in connection with
this agreement and our other agreements or if outside of scope of this agreement, any
relationships which result from our agreements or course of dealings, the performance or non
performance of our agreements, our business relationships, our communications, and our
transactions, no matter against whom made, and to claims or controversies about the
applicability of this arbitration clause, the validity of the entire agreement between the parties
and are not limited to claims that literally arise under the contract, but rather embrace all
disputes between the parties having a significant relationship to the contract regardless
of the label attached to the dispute.- all of which are referred to as “Disputes” and are to be
construed in the broadest manner possible except collection of monies owed to us by the
customer. We agree that all disputes or consumer claims described above, shall
be settled by arbitration administered by the American Arbitration association (“AAA”)
under its commercial arbitration rules, and judgment on the award rendered by the
arbitrator(s) may be entered in Harris county court in this case and pursuant to a transaction
involving interstate commerce, and shall be governed by and interpreted under the Federal
Arbitration Act (“FAA”) or 9-U.S.C-1-16. Arbitrator must adhere to the arbitration ethics
guidelines adopted by “AAA” and Alternative dispute resolution section of state bar of Texas.
Both parties hereby understand that by this agreement they have decided that their
disputes shall be resolved by binding arbitration rather than in court and once decided
by arbitration no dispute can be later brought, filed or pursued in court except to
enforce decision of the arbitrator. Parties also agree “NOT” to arbitrate any dispute
on a class-action basis, either as a representative or member of a class or as a private
attorney general, or to otherwise pursue any dispute in a class action or class arbitration.
This is referred to as a “ Class action Waiver”. Notwithstanding anything to the contrary
in this agreement, the validity and effect of the class action waiver shall be determined
exclusively by a court in Harris county. Neither the arbitration administrator nor any
arbitrator shall have the power or authority to waive, modify or fail or refuse to enforce
the class action Waiver, and any attempt to do so, whether by rule or policy, arbitration
decision or otherwise, shall be invalid and unenforceable.
The arbitrator shall issue a written opinion in support of their decision stating the legal
and factual basis for the decision and the reasoning leading to such decision. The
decision of the arbitrator shall be final, conclusive and binding on the parties to the
arbitration. Location of arbitration shall be in Harris county only. No arbitrator will have
authority to award relief in excess of total sales amount paid by the customer to purchase
the item or award any consequential, incidental, special, indirect, exemplary or punitive
damages or losses to the customer. Both parties agree that claims brought by or against
one customer may not be joined or consolidated in one arbitration or litigation
with claims brought by or against any other customer. Both parties agree that, despite
any rule providing that any one party must bear the cost of filing and/or the arbitrator’s fees,
all costs of the arbitrator(s) and all fees imposed by any arbitrator(s) hearing the dispute,
will be shared equally between both parties, unless such payment of costs would impose
a hardship upon the customer such that it would preclude you from vindicating your rights
under applicable law. The arbitrator(s) will decide whether such a hardship exists if there is
a substantial evidence to prove it. If the arbitrator(s) decide(s) that such a hardship exists,
both parties agree that, despite any other rules providing that one party must bear the cost
of filing and/or the arbitrators’ fees, all costs of the arbitration and all fees imposed by any
arbitrator(s) hearing the dispute will be paid by us.
The arbitration will be by an arbitrator to be agreed upon between the parties, or, failing
agreement, to a panel of three arbitrators, one to be appointed by us, one to be appointed
by the customer, and the third to be chosen by the two appointed arbitrators. There shall
be no reduction or shortening of the statue of limitations for a given claim under this
arbitration clause. Customer is required to request arbitration within the time period
allowed by law covering the type of claim. Arbitration hearing and award must be confidential
and proceedings will not be a matter of public record. Arbitrators shall be required to disclose
all former and current associations and relationships that would cause a reasonable person
to conclude the arbitrator was partial to one party to the arbitration.
Except as provided herein, if any part, clause or condition of this arbitration clause is held
by a court or the arbitrator(s) to be partially or wholly invalid, unenforceable, or inoperative
for any reason whatsoever, such shall not affect any other provision or portion hereof, which
shall continue to be effective as though such invalid, inoperative or unenforceable part, clause
or condition had not been made, and all other provisions of this clause shall be deemed valid
and enforceable to the fullest extent possible. If, however, the class action waiver is deemed
invalid or unenforceable with respect to any dispute, then this arbitration agreement shall,
upon election of either party, be invalidated and unenforceable in its entirety with respect to
that dispute.
If customer disputes the credit or debit card charge and if we win the chargeback dispute,
customer will be charged 10% of the total charge disputed as penalty.
14. Law and place of enforceability: This transaction and any legal issues arising out of this
transaction are governed by the laws of the state of Texas. Any lawsuit arising out of this
transaction be it to compel arbitration, enforce arbitration award or be it any or all lawsuits
in its broadest sense shall be filed in Harris county only, to the extent allowed by law.
15. Limited Warranty: We hereby disclaim and exclude all other warranties, express or implied,
including, but not all limited to any/or all implied warranties of merchantability, fitness for a
particular purpose and / or any warranty with regard to any claim of infringement that may be
provided in Uniform commercial code (UCC) and / or in any other comparable state statue.
This warranty is in lieu of all other express warranties of Engine World USA. Any implied
warranty is limited to the duration of this written warranty mentioned in clause # 1.
Engine World USA does not assume or authorize any distributor, dealer agent or employee
to increase the scope of this warranty or to assume any other obligation on their behalf.
This warranty embodies the entire agreement of the parties and supersedes all other
agreements, understandings or negotiations oral or written, with respect to the subject matter
hereto.
16. Collections : Customer authorizes us to hire or assign a collection agency to collect or recover
monies owed to us.
17. Purchase disclaimer: All sales of engines, transmissions and auto parts are subject to the

18. TAXES: Buyers are required to pay all taxes, duties & governmental charges in connection with
sale, purchase, delivery, transportation or use of the item sold, any and all taxes due remains

engines and transmissions are compiled from the information available from various
sources available and are not guaranteed to be accurate.
20. Shipping & notification on delivery notice: We ship only to a business address in a
commercial zone. We do not ship to military bases & home businesses in
residential areas. Shipment will be delivered between 9:00 AM- 5:00 PM at the
business address indicated by the customer. Customer will be charged $30 each
time the carrier fails to deliver the item if they do not find anyone to receive it at the
location. We will charge this amount only if the carrier bills us. If item is shipped to
a freight terminal of the shipping company, customer must pick it up within 48 hours.
If the shipping carrier bills us for any extra fee apart from actual freight concerning
customer’s shipment, we will charge customer the same amount billed. It is customer’s
responsibility to inspect the item at the time of delivery for damages, discrepancies
or incorrect (not as ordered) item shipped which must be explicitly mentioned on the
delivery notice, failing to do so will invalidate all claims pertaining to damages,
discrepancies or item not as ordered explained above, which were not informed on the
delivery notice. In short all claims that are not concerned with functionality of an engine or
transmission must be made before installation and must be mentioned on delivery notice.
Engine must be installed in the car for claiming any mechanical defect. CUSTOMER MUST
BE ABLE TO PROVE PHYSICAL DAMAGE. IT IS HIS OBLIGATION TO SEND US
PICTURES OF THE DAMAGE VIA EMAIL SO WE CAN FILE A CLAIM WITH THE
SHIPPING COMPANY. FAILURE TO DO SO, CUSTOMER WILL BE CHARGED
FOR ALL BACK & FORTH SHIPPING CHARGES BILLED BY THE SHIPPING COMPANY.
21. Notice : Any notice required to be sent under this agreement shall be in writing and deemed
given when mailed by certified mail, return receipt requested to our P.O box address only or
to such other address as either party, by notice to the other, may designate from time to time.
22. Absent fraud, misrepresentation or deceit, parties are bound by the terms of the contract he
signed regardless of whether he read it or thought it had different terms. All customers agree
